Augmented Games Event Waiver

1. Assumption of Risk

I acknowledge that participation in the Augmented Games Swarm Race (“Event”) involves inherent risks, including but not limited to: drowning, near-drowning, collision with other participants or watercraft, capsize, exposure to adverse weather conditions (wind, waves, sun, lightning), contact with marine life, physical injury, exhaustion, dehydration, hypothermia, and in extreme cases, serious bodily harm or death.

I understand that the Event takes place at Virginia Key, Miami, Florida, involving open water, coastal conditions, and mountain bike trails, and that water conditions, weather, terrain, and marine activity are inherently unpredictable and beyond the control of the Event organizers.

I voluntarily assume full responsibility for all risks of injury, illness, or death that may result from my participation in the Event, whether caused by the negligence of the Released Parties or otherwise.

2. Release of Liability

In consideration of being permitted to participate in the Event, I hereby release, waive, discharge, and covenant not to sue Betterness Inc., PADL, Lab Miami, their respective officers, directors, employees, agents, volunteers, sponsors, partners, venue operators, and all other persons or entities acting in any capacity on their behalf (collectively, “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, whether caused by the negligence of the Released Parties or otherwise, while participating in the Event or while in, on, or around the Event premises.

3. Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur due to my participation in the Event, whether caused by my negligence or otherwise.

4. Medical Declaration

I declare that I am in adequate physical condition to participate in a multi-discipline event (sailing, paddling, and mountain biking) and have no medical conditions that would prevent my participation or create undue risk to myself or others. I authorize the Event organizers to seek emergency medical treatment on my behalf if I am unable to communicate my wishes, and I accept financial responsibility for any such treatment.

5. AI Competition Consent

I understand that the Event features AI-generated race strategies designed by autonomous AI agents (“Bots”). I consent to having my submitted competitor data (physical stats, experience levels, personality responses) analyzed by AI systems for the purpose of competitor selection and strategy design.

I acknowledge that I may be asked to follow an AI-generated race strategy during the Event. I understand that AI-generated strategies are advisory in nature and that I retain full autonomy over my actions during the race. The Released Parties shall not be liable for any outcomes resulting from AI-generated strategies, whether followed or not.

6. Media Release

I grant the Released Parties the irrevocable right to use my name, image, likeness, voice, biographical information, submitted data, and any photographs, video, or audio recordings taken during the Event for any purpose, including but not limited to promotion, advertising, streaming, broadcasting, social media, editorial content, and commercial use, in any medium now known or hereafter developed, without compensation or prior approval.

I consent to the public display of my competitor profile information, including headshot photo, display name, social media handles, company/startup affiliation, physical stats, and competition data on the augmentedgames.ai platform and related materials.

7. Event Rules & Equipment

I agree to abide by all Event rules and instructions provided by Event officials. I understand that the Event organizers reserve the right to modify, suspend, or cancel the Event at any time due to weather, safety concerns, or other circumstances. I agree to wear a personal flotation device (PFD) at all times while on the water and to use only Event-approved equipment.

8. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under this Waiver shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.

9. Severability

If any provision of this Waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

10. Entire Agreement

This Waiver constitutes the entire agreement between me and the Released Parties with respect to the subject matter hereof. This Waiver supersedes all prior agreements and understandings, whether written or oral.

11. Electronic Acceptance

I acknowledge that my electronic acceptance of this Waiver via the augmentedgames.ai registration process constitutes a legally binding signature, equivalent to a handwritten signature, and indicates my full understanding of and agreement to the terms set forth herein.
